U.S. Immigration H1-B Application Tips
New rules for H-1B applications are here!
Starting this year, there are new adjustments to H-1B policy that may affect your filing strategy:
1. Grading by Salary
The new government is considering allocating H-1B slots based on salary level, which simply means that ‘higher salary is preferred’. If the salary of your position is in Level 1 (the lowest), the approval rate of your application may be affected. However, the policy is still under discussion and may not be implemented this year.
2. Updated Definition of ‘Professional Vacancies
The definition of ‘Professional Vacancies’ has been restructured to require that the posts must involve highly specialised knowledge and the applicants must hold a degree in the relevant field.
3. Enhanced Compliance Audit
To prevent abuse of the H-1B programme, USCIS has stepped up its efforts to scrutinise employers, including more site visits and audits. Therefore, both employers and applicants must ensure that the documents are truthful and compliant.
