1. Make early preparations
- Find an employer: Talk to the employer in advance to confirm that they are willing to apply for your H-1B visa.
- Prepare your documents early: proof of education, transcripts, professional certifications, proof of work experience, and other documents.
2. Focus on policy
- Pay attention to official news: Check the USCIS website and reliable sources regularly for the latest information on H-1B policies.
- Consult an expert: If you have a complex situation, it is advisable to consult an immigration lawyer or consultant to understand how the policy change may affect your application.
3. Conforming to specifications
- Highlight Professional Skills: If you are lucky enough to be selected, highlight how your skills and qualifications meet the requirements of the ‘Professional Position’ in your subsequent H-1B application.
- Ensure employer compliance: Confirm with the employer that the company is complying with all H-1B regulations, such as filing a Labour Condition Application (LCA).
4. Planning ahead for alternative pathways
- Other Visas: If the H-1B lottery is not successful, other options such as O-1 (Outstanding Talent Visa), L-1 (International Assignment Visa) or Day 1 CPT may be considered.
Important Date
- March 7 - March 24: Open H-1B registration, during which employers file registrations for applicants.
- March 27 - March 31: The Immigration Department conducts the lottery and will receive notification of successful applicants by 31st March.
- April 1 - June30: H-1B petition filing period, during which successful applicants can formally submit their H-1B petitions.
- October 1: H-1B official effective date.
